The Carmarthenshire County Council (Ffairfach To Whitemill Shared Use Route) Compulsory Purchase Order 2023
The Town and Country Planning Act 1990 Local Government (Miscellaneous Provisions) Act 1976 and The Acquisition of Land Act 1981 Compulsory Purchase of Land and New Rights Between Whitemill and Ffairfach Carmarthenshire

- Notice is hereby given that the Welsh Ministers in exercise of their powers under the above Acts, on the eighteenth day of April Two Thousand and Twenty Four confirmed with modifications The Carmarthenshire County Council (Ffairfach to Whitemill Shared Use Route) Compulsory Purchase Order 2023 submitted by the Carmarthenshire County Council ("the order").
- The order provides for the purchase of the land and the new rights over land described in Schedule 1 below for the purposes of:
(a) Facilitating the development of land by the construction of a shared use route suitable to accommodate both pedestrians and cyclists which will extend in a westerly direction from Ffairfach, Llandeilo to Whitemill, a distance of approximately nineteen decimal point two two (19.22) kilometres, which route once constructed will contribute to the achievement of the promotion and improvement of the economic, social and environmental well-being of its area. - A copy of the order and of the map referred to in the order have been deposited at Carmarthenshire County Council's Customer Service Hwb at Unit 22 St. Catherine’s Walk, Carmarthen SA31 1GA and at The Carmarthen Library at St Peter’s Street Carmarthen SA31 1LN and may be inspected free of charge during normal office hours and also at Llandeilo Library Crescent Road, Llandeilo, SA19 6HN (N.B. Llandeilo Library is closed Monday and Thursday). The order and map may also be viewed on Carmarthenshire County Council’s website.
- The order becomes operative on the date on which this notice is first published. A person aggrieved by the order may, by application to the High Court within six (6) weeks from that date, challenge its validity under section 23 of the Acquisition of Land Act 1981. The grounds for challenge are that the authorisation granted by the order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the order.
- Once the order has become operative, Carmarthenshire County Council may acquire any of the land described in Schedule 1 below by executing a general vesting declaration under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981. A statement on the effect of Parts 2 and 3 of that Act is set out in Schedule 2 below.
- Every person who, if a general vesting declaration were executed under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981 in respect of the land comprised in the order (other than land in respect of which notice to treat has been given), would be entitled to claim compensation in respect of any such land, is invited to give information to the Carmarthenshire County Council at County Hall Carmarthen SA31 1JP as to the person’s name and address and the land in question, using a prescribed form. The relevant prescribed form is set out in Schedule 3 below.
